Abstract

This dissertation examines the 2014 revision of China's Administrative Litigation Law (ALL), analyzing its aims, key features, and implications within the country's unique political and legal context. The revision sought to address the "three difficulties" of the 1989 ALL, namely, difficulties in filing lawsuits, case adjudication, and judgment enforcement. The study explores how the revision reflects the CCP's commitment to "legislative pragmatism" and its goal of establishing an "administration according to law" while maintaining political control.

Die Dissertation untersucht die im Jahr 2014 erfolgte Revision des chinesischen Verwaltungsprozessrechts (VPG) und analysiert dessen Ziele und Merkmale eingebettet in den politischen und rechtlichen Kontext der Volksrepublik China. Mit der Revision des VPG sollten die „drei Schwierigkeiten“ gelöst werden. Denn die Umsetzung des VPG von 1989 wurde erschwert durch Probleme bei der Einreichung von Klagen, der Entscheidung von Fällen und der Vollstreckung von Urteilen. Die Dissertation untersucht, inwiefern die Revision die Verpflichtung der Kommunistischen Partei Chinas zu „gesetzgeberischem Pragmatismus“ und zu ihrem Ziel widerspiegelt, eine „Verwaltung nach dem Gesetz“ zu schaffen und gleichzeitig die politische Kontrolle zu behalten.
