Abstract

In a recent decision, which in different respects opens up new lines of enquiry, the Administrative Court of Cologne (Verwaltungsgericht Koln) dismissed an action by which the plaintiff sought to oblige Germany to request the extradition of 13 CIA agents involved in his 'extraordinary rendition' from the United States. This article describes the history of the case that has been met with great interest in the press and in legal circles, and analyses the reasoning of the Court on the admissibility and merits of the case.
