Abstract

Die vorliegende Untersuchung dekonstruiert die systemische Diskrepanz zwischen prozeduraler Normativität und operativer Notwendigkeit in der deutschen Schienenverkehrssteuerung. Im Fokus steht das Phänomen der „Brauchbaren Illegalität“ als funktionales Äquivalent zur Aufrechterhaltung der Netzkapazität unter Bedingungen infrastruktureller Fragilität. Unter theoretischer Bezugnahme auf die Normal Accident Theory und das Job-Demand-Control-Modell wird nachgewiesen, dass die Richtlinie (Ril) 408 über ihre technische Steuerungsfunktion hinaus als Instrument einer organisationalen Haftungsdelegation fungiert. Diese Struktur zwingt das operative Personal (Fahrdienstleiter) in eine systemische Verantwortungsfalle: Während die Organisation von der informellen Effizienzsteigerung durch Regelbeugung profitiert, verbleibt das strafrechtliche Haftungsrisiko auf der Individualebene. Die Arbeit identifiziert diese Konstellation als primären Prädiktor für funktionale Erschöpfung und Moral Injury. Damit liefert die Untersuchung einen kritischen Beitrag zur Debatte über Safety-II und die Resilienz kritischer Infrastrukturen (KRITIS).

Translated abstract:	Abstract Language This study deconstructs the systemic discrepancy between procedural rigor and operational necessity within German railway operations. It focuses on the concept of "Useful Illegality" as an indispensable functional element for maintaining network capacity under conditions of infrastructural instability. Drawing on Normal Accident Theory and the Job-Demand-Control Model, the analysis demonstrates that Rulebook 408 serves a secondary purpose as an instrument for the organizational delegation of liability. This structure forces operational personnel into a systemic "responsibility trap," where the organization benefits from informal efficiency gains through rule-breaking while the legal liability remains with the individual operator. The study identifies this constellation as a primary predictor of functional exhaustion and moral injury. Thus, the research provides a critical contribution to the discourse on Safety-II and the resilience of Critical Infrastructures (CRITIS). English
