Abstract
Die Arbeit unternimmt es, den Begriff Sport für die Rechtswissenschaft zu definieren. Sie geht aus von einer allgemeinen Analyse juristischer und außerjuristischer Begriffe und Definitionen. Auf dieser Grundlage faßt sie Sport zunächst als allgemeinsprachlichen Begriff auf. Der Ausdruck "Sport" erweist sich danach als mehrdeutig, indem er einerseits bestimmte körperliche Betätigungen ("Körpersport"), andererseits bestimmte Arten von Wettkämpfen ("Wettkampfsport") bezeichnet. Die Arbeit untersucht sodann, ob sich dieses allgemeinsprachliche Sportverständnis auch für die juristische Fachsprache eignet. Das hängt davon ab, ob es den einschlägigen Bestimmungen des deutschen und europäischen Rechts angemessen ist. Im Ergebnis bejaht der Verfasser diese Frage.

| Translated abstract: | Abstract Language This paper attempts to offer a definition for what constitutes a "sport" under German and European law. It includes a general analysis of legal and non-legal concepts and definitions. It first examines "sport" within a non-legal context. In this respect, the term "sport" is ambiguous, in that it stands for some kind of physical exercise on the one hand ("body sport") and for certain ways of competition on the other hand ("competitive sport"). The paper goes on further to examine whether this non-legal, common understanding of "sport" is also suitable in a legal context. This depends on whether it is appropriate pursuant to German and European law. The author comes to the conclusion that the answer to this question should be in the affirmative. English |
